Copyright Claim Policy

The conference laid down the role and responsibilities of authors, corresponding authors, applicants, supporting / funding agencies, conference, investigation team, financial claim, and legal claim under the copyright claim policies.

  • Role and Responsibilities of Authors

    • All Authors sole responsible for the copyright claim on the article.
    • The conference investigation result of the copyright claim must be accepted by all authors, direct or indirect contributors, and supporting/ funding agencies of the article.
    • All authors must reply to the conference email subject to copyright claim within six months of the copyright claim received to the conference.
    •  Within six months after the copyright claim is received at the conference, if the corresponding author or any authors of the article, supporting/ funding organization, or any direct or indirect contributor person of the article are not replying to the conference email subject to the copyright claim, then the conference investigation team consider as conviction of copyright claim by all any authors, corresponding author, supporting/ funding organization and any direct or indirect contributor person of the article.
  • Role and Responsibilities of Corresponding Authors

    • Corresponding authors/ authors are solely responsible for signing the copyright transfer agreement on behalf of all authors of the article.
    • If a copyright claim is received to the conference then the corresponding author is the initial contact of the article for the conference.
    • If a copyright claim is received to the conference then the corresponding author's sole responsibility is to inform about the claim of the article to other authors.
    • Conference sends the email to the only corresponding author in case of a copyright claim, the corresponding author is responsible to reply to the conference's email.
    • Within six months after copyright claim is received to the conference, if the corresponding author or any authors of the article, supporting/ funding organization, or any direct or indirect contributor person of the article are not replying to the conference email subject to the copyright claim, then the conference investigation team consider as conviction of copyright claim by all any authors, corresponding author, supporting/ funding organization and any direct or indirect contributor person of the article.
  • Role and Responsibilities of Applicant

    • Applicants can submit a copyright claim on only articles published in the conference.
    • Applicants can submit the copyright claim only to the conference; other claims does not investigate by the conference.
    • The applicant must follow the policies of the conference for the copyright claim.
    • The applicant waits for the investigation process minimum duration is six months.
    • The applicant can make a legal claim on the article after the completion of the conference investigation.
    • The applicant can not do submit any financial claim (demand or loss) to the conference. That claim directly communicates with the authors of the article.
  • Role and Responsibilities of Supporting / Funding Agencies

    • The conference also emails to supporting/ funding agencies of the article in case of a copyright claim received to the conference.
    • If supporting/ funding agencies of the article received mail from the conference subject to copyright claim then the agency's responsibility is to inform all authors of the article.
    • Supporting and funding agencies are mandatory to reply to the conference emails subject to copyright claims within six months of the claim received to the conference.
    • Within six months after the copyright claim is received to the conference, if the corresponding author or any authors of the article, supporting/ funding organization, or any direct or indirect contributor person of the article are not replying to the conference email subject to the copyright claim, then the conference investigation team consider as conviction of copyright claim by all any authors, corresponding author, supporting/ funding organization and any direct or indirect contributor person of the article.
  • Role and Responsibilities of the Conference

    • Action will be taken against the claim received to the conference as per the conference policies, the COPE guidelines, and scholarly communities for research and publications guidelines.
    • Create a separate investigation team for each copyright claim.
    • Information about the investigation team member must be confidential.
    • The conference does not accept any author and applicant request to add a member to an investigation team of a copyright claim. The process of investigation creation, role, responsibilities, and evaluation process as per the policies of the conference.
    • The minimum time duration of the copyright claims investigation needed six months.
    • The conference works for claims till investigation team members generate the result after the basis of the result action will be taken on the article.
    • The conference will make a financial claim on the person who uses an article published in the conference without the permission of the author and publisher, who used the article for self-interest or commercial purpose.
    • In copyright claim the conference contacts the corresponding author only, the corresponding author is responsible to communicate with other authors of the article.
    • Within six months after the copyright claim is received to the conference, if the corresponding author or any authors of the article, supporting/ funding organization, or any direct or indirect contributor person of the article are not replying to the conference email subject to the copyright claim, then the conference investigation team consider as conviction of copyright claim by all any authors, corresponding author, supporting/ funding organization and any direct or indirect contributor person of the article.
  • Roles and Responsibilities of the Investigation Team

    • Any members of the investigation team do not have a conflict of interest regarding the article.
    • All members of the investigation team keep all investigation information confidential (like member’s personal detail, investigation process, etc.)
    • Investigation team members follow the investigation as per the conference policies and the COPE guidelines.
    • Any member of the investigation team does not try to communicate directly with authors, applicants, or any person of the article involved in a copyright claim.

Financial Claim

    • The financial loss of any applicant or person who make claim on the article not investigated by the conference.
    • If any authors, applicants, users, organizations, publishers, or agencies use the conference published work for commercial purposes or self-interest, or for personal financial profit ( eg. subscription basis) then the conference makes a legal and financial claim against it.
    • The applicant or anyone who wants to make a financial claim on an article in case of a copyright claim needs to directly communicate to the corresponding authors or any authors of the article. Conference only helps them to decide whether the work is plagiarized or not, or whether the result of a copyright claim is positive or negative.

Legal Claim

legal claim applied on any author only when not satisfied by conference investigation of the plagiarism.

  • Role and Responsibilities of All Authors

    • Authors have the right to a legal claim on the user of the article who is not given the credits to authors of the article or also on the person who uses the article for commercial purposes or for self-interest.
    • In case of legal action taken by anyone on published article in the conference, only all authors and contributors of the article bounded to reply and co-operate the legal claim as per conference policies and sign copyright transfer agreement.
    • Authors and contributors of articles sole responsible for legal claim judgments taken by the judiciary system.
    • In case the author is unsatisfied with the result of the conference copyright claim investigation team, so in that case, the conference takes a suggestion from other scholarly publication committees on behalf of authors or authors also can contact directly to scholarly publication committee for help, throughout all these processes authors, applicants must maintain discipline and politeness to the conference.
    • In case of a copyright claim on authors to an article published in the conference must wait until the process duration minimum of 6 to 12 months and must maintain discipline, and politeness. If authors misbehave or unwanted emails send to the conference the case conference takes legal action against the person who misbehaves or unwanted mail is sent to a conference.
    • In case copyright claim against the author of the article published in conference unsatisfied from the result of the investigation team and scholarly publication committee suggestion. In that case (after completion of both process investigation result and scholarly publication committee suggestion) authors have the right to take help from the judiciary system.
    • Conference only cooperates with them (authors and applicants) to decide whether the work is plagiarized or not, or whether the result of a copyright claim is positive or negative.
  • Role and Responsibilities of Applicants

    • Applicants have the right to a legal claim on authors only of the article who are not given the credits to applicant work use an article which is published in the conference.
    • In case of someone use the copyright content in the article which is published in the conference and is not given proper credit (cite) to the copyright holder. In that case, the persons who used the content are solely responsible for a legal claim by the applicant.
    • Applicant must follow the conference policies and conference investigation for plagiarism before legal claim.
    • The applicant does not have the rights to make any financial, legal claim, or judiciary on the conference.
  • Role and Responsibilities of the Conference

    • The Conference has the right to make a legal claim on anyone who uses article copyright content published in a conference without taking permission and not giving credit to authors and conference.
    • The conference has the right to make a legal and financial claim if anyone is using the conferenece-published work for commercial purposes.
    • The conference's responsibility is to investigate copyright claims and generate the result of the investigation positive or negative.
    • In case of a legal claim against the authors of the article published at the conference. In that case, the conference only cooperates with them (authors and applicants) to decide whether the work is plagiarized or not, or whether the result of a copyright claim is positive or negative. Legal claim issues communicate to both parties (applicants and authors) mutually. The conference does not involve in the legal claim in the article.
    • The conference does not involve settling the legal claim issue between both parties (applicants and authors).
    • The conference takes a suggestion from the scholarly publication committee if anyone or both parties (applicants and authors) are not satisfied with the conference investigation result.
    • The Conference investigation and taken scholarly publication committee suggestion for copyright claim required minimum duration is 6 to 12 months.
    • In case authors or applicants are not satisfied with the result of the investigation team and scholarly publication committee suggestions conference suggests to both authors and applicants to take help from the judiciary system help.
    • In case copyright claim move inside the judiciary system conference provide all needed documents to applicants and authors and equally cooperate with the applicant and authors.
    • The conference will accept the judgment of the judiciary system against the legal claim.
    • In case a copyright claim moves inside the judiciary system the conference publish online under the article in HTML “article under the process of copyright claim case move in a legal claim under the judiciary system”.
    • If the judiciary system gives the judgments in favor of the applicant then the link will be removed from the conference and the link of the article containing the judiciary system judgment copy in PDF and in HTML below the link of the “article shown Article removed under copyright act by the judgment of the judiciary system”.
    • If the judiciary system judgments in favor of the authors the article link keep as it is in a conference and removes the HTML label “article under the process of copyright claim case move in a legal claim under the judiciary system”.
